FIT College was formed with one simple goal: To graduate quality Personal Trainers ready to start a career in fitness, in any fitness environment. Since our inception, we have worked tirelessly to provide high quality fitness courses, practical and varied learning materials, and a broad range of interesting and helpful resources to create the highest quality courses available. FIT College also operates FC Education which delivers Fitness Training, Education & Business Courses, and Fitness Management courses.

FIT College Terms and Conditions

1. COURSE REGISTRATION

  1. By agreeing to the course registration, 'The Biller or Parent/Guardian’ as named in the Confirmation of Registration is liable for the total purchased product(s) cost.
  2. Individuals who agree to the course registration acknowledge reading and understanding the FIT College Terms and Conditions, Student Handbook, and any accompanying third-party company terms.
  3. If the 'The Biller or Parent/Guardian’ is not the prospective student, all parties must complete a registration agreement.
  4. FIT College must authorise adjustments to enrolment after registration before being actioned. Please refer to the Student Handbook under Learner Action Requests for further information.
  5. The student is obligated to complete an online enrolment within seven (7) days to avoid delay. Failure to complete the online enrolment does not release the student from their obligations.

2. COURSE DELIVERY

  1. All VET courses FIT College offers are nationally recognised and publicly listed on training.gov.au. The student is encouraged to search FIT College on the registry.
  2. Completing the course is the student's responsibility, and the student shall be liable for all associated costs, whether the course is completed or not.
  3. The allowable time to complete the course(s) is specified within the Confirmation of Registration.
  4. The student may purchase an extension if they do not complete the course(s) within the allowable time. For fee structure, please see the 'Fees' section. Extensions must be applied and paid for within thirty (30) days of the allowable time expiration date, after which time the student must re-enrol.
  5. The completion date is when the student's final assessment task in any full qualification or short course is marked as competent or when the Study Completion Date ends, whichever occurs first.
  6. The certificate issue date is when all financial and education requirements for the purchased product have been fulfilled. For financial requirements, please see the 'Product Purchase' section.
  7. FIT College shall issue digital certificates to the student’s registered email accounts. Hard copies and replacements for damaged or lost certificates may be requested. However, fees apply (refer to the Fees section).

3. Student OBLIGATIONS

  1. The student agrees to:
    1. Attend the course by the agreed mode of study, on the agreed starting date, for the course duration until completion;
    2. Pay all course fees when they are due payable;
    3. Adhere to any student visa conditions at all times and
    4. Adhere to the Student Handbook, Terms and Conditions, behavioural requirements, and any lawful directions and reasonable requests from FIT College, its staff, representatives, and agents.

4. FIT COLLEGE OBLIGATIONS

  1. FIT College shall maintain its status as a registered training organisation.
  2. FIT College shall provide the course to an enrolled student pursuant to the Confirmation of Registration, these Terms & Conditions, the Student Handbook, and its policies.
  3. FIT College can refuse to provide the goods and services if the student or the ‘Biller or Parent/Guardian’ breaches the Confirmation of Registration, these Terms & Conditions, the Student Handbook, and its policies and the breach is not remedied within seven (7) days or cannot be remedied at all.

5. RECORDS

  1. FIT College uses its best endeavours to ensure all relevant student records are current and accurate.
  2. FIT College retains student records for at least 26 weeks after completion.
  3. FIT College retains records for at least seven (7) years after government-funded students complete their course(s).
  4. FIT College reserves the right to dispose of materials not claimed after the retention period has lapsed.
  5. Certain records are available to the student upon request and may incur additional fees.
  6. Requests for records on behalf of a student must have authorisation.
  7. FIT College will NOT release your details to any third party without a legal reason unless authorisation has been provided in the approved form.
  8. FIT College shall keep records of students, including but not limited to:
    1. The student's current residential address;
    2. The student's mobile phone number (if any);
    3. The student's email address (if any);
    4. The student's emergency contact; and
    5. Any other details prescribed by the regulations.
  9. The student must notify FIT College of any changes to the details above within seven (7) days of the change.
  10. FIT College shall record up-to-date outcomes of an accepted international student's completed topics of study that have been assessed in accordance with any requirements prescribed by the regulations. FIT College shall retain these records for at least two (2) years after the student ceases being an enrolled international student with FIT College.
  11. The student is responsible for keeping a copy of the written agreement supplied by FIT College and receipts of tuition or non-tuition fee payments.

6. PRODUCT PURCHASE

  1. FIT College maintains a security interest in the certificates and will not release them to students until the full payment for the qualification course costs has been made.
  2. Failure to pay the qualification course costs in full within three years of course completion will result in the qualification no longer being current, and the student will be required to undertake additional training for an additional cost to demonstrate currency and comply with the relevant training package.
  3. FIT College adheres to the Australian Consumer Law (ACL) and guarantees its goods and services, including:
    1. Fixing minor issues with services within a reasonable time after a student submits a Learner Action Request (LAR) in the approved format;
    2. Repairing or replacing goods within a reasonable time after a student submits a Learner Action Request (LAR) in the approved format;
    3. Providing a prorated refund for unused goods that it cannot repair within a reasonable time;
    4. Providing compensation for the reduced value of goods or services if there is a major failure of the goods and services and the remaining part of the contract can be fulfilled;
    5. Providing a refund for unconsumed goods and services pursuant to the Standards for Registered Training Organisation (RTOs) 2015 if FIT College can no longer legally deliver the goods or services.
  4. The student may be eligible for government funding.
    1. To determine eligibility for funding, the student must provide FIT College with proof of identity, residency, and Australian or New Zealand citizenship, or any other evidence required by the relevant State or Territory government.
    2. Should the student not be eligible for funding or fail to supply the required documents when due, the ‘Biller or Parent/Guardian’ will remain liable for the total cost of the course.
    3. If the student receives government funding toward a FIT College course, this may impact their eligibility to obtain government funding elsewhere in the future.

7. COOLING OFF PERIOD

  1. A 72-hour cooling-off period (including weekends/public holidays) begins when the Confirmation of Registration is signed by the named ‘Biller or Parent Guardian’.
  2. The Confirmation of Registration may only be terminated or amended within the 72-hour cooling-off period. See section 11 of these Terms & Conditions for further information.
  3. The cooling-off period ceases when any of the following occurs:
    1. 72 hours have passed since the Confirmation of Registration was submitted by the student;
    2. The student has attended a class;
    3. The student has logged into the student platform; or
    4. The student has received or accessed any goods.
  4. Upon completion of the cooling-off period, the ‘Biller or Parent/Guardian’ and the student named in the Confirmation of Registration must continue to meet their obligations, including any financial agreement, and the goods can no longer be rejected.

8. DIRECT DEBIT PAYMENT PLAN

Enrolments not associated with a direct debit payment plan can disregard the following items.

  1. Direct debit payment plans are serviced through the third-party direct debit service provider 'FFA PaySmart'.
  2. The PaySmart direct debit service agreement is provided to the ‘Biller or Parent/Guardian’ named in the Confirmation of Registration.
  3. Adjustments to an existing direct debit payment plan must be requested via a Learner Action Request (LAR) and authorised by FIT College before being actioned. Please refer to the Student Handbook under Learner Action Requests for further information.
  4. FFA PaySmart Product Disclosure Statement & Service Agreement are provided to the ‘Biller or Parent/Guardian’ named in the Confirmation of Registration during the registration process.
  5. Direct debit payments may be suspended by application through a Learner Action Request (LAR) outlining your current situation and financial circumstances. A direct debit suspension can only be authorised after:
    • A minimum of (1) direct debit payment has been settled and 
    • A total of $500.00 has been paid to the account.

Where financial hardship is expected to last more than four (4) weeks, we may also require supporting documentation such as a redundancy letter from the employer, bank statements, and payslips. If your application is approved, the available payment options include but are not limited to: 

  • Suspended payments for a short time 
  • Reduced payment amounts 
  • Deferred enrolment to start later to allow you to gain different employment or income

Students may submit a LAR requesting up to four weeks of payment suspension while they gather evidence of financial hardship and exhaust all reasonable options to pay down the debt. After the suspension period, students are expected to resume payments as per the agreed-upon payment plan unless a further extension of no more than four (4) weeks has been granted.

  1. PaySmart Fees and Payments are as follows:
    • Each defaulted payment through PaySmart direct debit will incur a $15.00 default fee, which is capped at $45.00 before the account is Archived.
    • Credit Card payments may incur surcharges.
    • A setup fee of $5.50 is debited along with your first payment with PaySmart.
    • Administration fees are debited by PaySmart as follows:
      • Weekly payments incur a $1.30 administration fee; fortnightly payments incur a $1.95 administration fee, and monthly payments incur a $2.95 administration fee.
    • Failure to remedy payment defaults with PaySmart direct debit within seven (7) days of the Account being Archived will result in the account being referred for debt recovery.
    • The 'The Biller or Parent/Guardian’ agrees to pay all reasonable costs associated with debt recovery efforts, including but not limited to legal costs.

9. MARKETING & RECRUITMENT

  1. FIT College uses its best endeavours to comply with the marketing and recruitment requirements of Standards for Registered Training Organisations (RTOs) 2015.
  2. FIT College shall not engage in misleading or deceptive conduct concerning recruitment or marketing and transparently provides all relevant information to the student prior to enrolment on its website, via email correspondence, and within the Confirmation of Registration. FIT College recommends that the student thoroughly reads and understands the information before completing the Confirmation or Registration and no later than the expiration of the cooling-off period.
  3. Careers Advisors assist prospective students in understanding the course(s) and relevant information so that they can make an informed decision before self-completing the Confirmation of Registration. The student agrees that they have fully read and understood the documented information provided on the FIT College website, in email correspondence, and within the Confirmation of Registration. The student acknowledges that their decision to enrol is primarily based on the written documentation provided by FIT College and that verbal representations made by Careers Advisors are supplementary and not binding unless confirmed in writing by FIT College.
  4. FIT College shall maintain a list of all its Education Agents and publish it on its website and in any other manner prescribed by the regulations.
  5. At times, FIT College may use third-party companies. In these circumstances:
    1. FIT College is not responsible for any of the third-party websites, products, or services; and
    2. Use of Third-party content is at the user’s own risk.

10. FEES

  1. FIT College reserves the right to set course fees and offer periodic promotions to prospective students. Promotional offers can only be used once when the student completes the Confirmation of Enrolment and cannot be applied retrospectively.
  2. A withdrawal fee of $125.00 (per qualification) is applicable within the cooling-off period.
  3. An administration fee of $250 (per qualification) applies to approved course withdrawals.
  4. Additional education course support for students costs a fee of $60.00 per hour.
  5. A hard copy of a certificate may be requested for a fee of $50.00 per certificate.
  6. Extension to course's allowable time cost:
    1. One month for $150
    2. Three months for $300
    3. Six months for $500
    4. Extensions must be paid for each term before each term commences
    5. If an extension fee is paid late, the new extension term  will be backdated to the expiry of the previous allowable time
  7. A postage fee of $5.00 applies for the re-post of products
  8. Changes to study mode incur an administration fee of $125 per transfer. Refer to the Student Handbook under 'Changes to study mode' for further information
  9. International (ESOS) students have a $500 enrolment fee in addition to the course costs, which must be paid upon enrolment.
  10. International student (ESOS) course costs and fees vary and can be subject to discounts. All fees associated with the cost of courses purchased are outlined in the written agreement.
  11. International (ESOS) Students can pay their tuition fees in the following ways
    1. For each term before the commencement of each term;
    2. For each Semester before the commencement of each Semester; or
    3. For each year before the commencement of each year.

11. REFUNDS

  1. FIT College shall not provide a refund if:
    1. The student withdraws from the course(s).
    2. The student has changed their mind.
    3. The student fails to pay an amount they were liable to pay.
    4. The student's personal, financial, or family circumstances have changed.
    5. The student was refused a student visa due to the student's failure to start the course at the location on the agreed starting day or
    6. The student has breached a condition of their Confirmation of Registration, these Terms & Conditions, the Student Handbook, or FIT College policy.
  2. FIT College may provide a partial refund if:
    1. The student submits verified specialist medical evidence of a terminal illness or permanent disability diagnosed after registration that prevents study. Existing medical conditions diagnosed and documented before registration will not be eligible for a refund. The student must promptly contact FIT College if they have a terminal illness or permanent injury so that it can assist the student in gathering the required information to support any claim.
    2. FIT College is unable to provide the course pursuant to the Confirmation of Registration or other agreement entered after that by the student.
    3. The student has made an overpayment.
  3. A Registration Agreement (letter of offer, application, and enrolment form) is legally binding. If you have paid in full, please review our Refund Policy.

12. ENTIRE AGREEMENT

  1. FIT College may adopt appropriate clauses from time to time for the management of operational requirements or to meet legal obligations.
  2. FIT College reserves the right to withdraw or vary these Terms & Conditions at any time, which all students must adopt, provided the change does not relate to price increases. A notification of changes to the Terms and Conditions will be published through the learning platform within three (3) business days of changes being made.
  3. FIT College Terms & Conditions are located on the student platform and company website for the public to view.
  4. These Terms & Conditions, and the right to make complaints and seek appeals of decisions and actions under various processes, do not affect the student's rights to take action under the Australian Consumer Law if the Australian Consumer Law applies.

13. FIT COLLEGE OBLIGATIONS TO INTERNATIONAL STUDENTS

FIT College Obligations to International Students:

  1. FIT College shall comply with the ESOS Act, the ESOS Regulations, and the National Code.
  2. FIT College shall notify its ESOS agency as soon as practicable if it becomes aware that an associate or high managerial agent fails to comply with section 17 of the ESOS Act.
  3. FIT College shall notify its ESOS agency, within ten business days or as soon as practicable before the change, of:
    1. Any event that would significantly affect its ability to comply with the ESOS Act.
    2. Any change of ownership of FIT College or
    3. Any prospective or actual change concerning a related person of FIT College.
  4. FIT College is bound by the ESOS Act to provide its ESOS agency with relevant student information within 31 days or as soon as practicable when:
    1. FIT College accepts a student enrolment.
    2. An excepted student fails to commence their course when expected.
    3. An accepted student's studies are terminated.
    4. Any change in the identity or duration of an accepted student's course.
    5. Any breach of prescribed conditions of a student visa of an accepted student or
    6. Any other prescribed matter relating to accepted students.
  5. FIT College shall pay relevant charges under the Education Services for Overseas Students (Registration Charges) Act 1997 and the Education Services for Overseas Students (TPS Levies) Act 2012 while it is, and intends to be, a registered provider.
  6. FIT College shall send an accepted student a written notice if the student has breached a prescribed condition of a student visa, even if the student has ceased to be an accepted student of the provider, as soon as practicable after the breach.
  7. The notice will contain particulars of the breach and require the student to attend in person before an officer (within the meaning of the Migration Act 1958) at a specified place within 28 days after the day specified in the notice as the date of the notice, to make any submissions about the breach and the circumstances that led to the breach and state that the student must present photographic identification when so attending and set out the effect of sections 137J and 137K of that Act.
  8. Students facing default due to misbehaviour will be afforded natural justice before FIT College refuses to provide, or continues providing, the course to the student at the agreed location.

14. INTERNATIONAL STUDENT FEES 

  1. FIT College shall not receive, in respect of an overseas student or intending overseas student, more than 50% of the student's total tuition fees for a course before the student has begun the course unless:
    1. the student, or a person who is responsible for paying those fees, chooses to pay more than 50% of the overseas student, or intending overseas student's, total tuition fees for a course before the student has begun the course or
    2. if the course has a duration of 25 weeks or less.
  2. FIT College maintains an account with an Australian ADI (within the meaning of section 9 of the Corporations Act 2001) for fees received before an overseas student or intending overseas student course commencement. FIT College shall credit this account within five business days of receiving prepaid course fees.
  3. FIT College shall ensure that a sufficient amount is standing to the credit of the account to repay all tuition fees to every overseas student or intending overseas student in respect of whom tuition fees have been paid to the provider and who has not yet begun the course that the provider is to provide to the student.
  4. FIT College shall only withdraw from the account to pay a refund only if:
    1. The amount is withdrawn to provide a refund under sections 46D, 47D or 47E of the ESOS Act to, or concerning, a relevant student or
    2. The provider arranges, under section 46D, for a relevant student to be offered a place in an alternative course at the provider's expense, and the amount is withdrawn to pay the alternative provider concerning the applicable student or
    3. The amount is withdrawn to pay the TPS Director under section 50C concerning the relevant student.
  5. Should FIT College enter into an arrangement with one or more other providers to provide the course jointly, students will be required to pay their tuition fees to:
    1. FIT College and not directly to the other providers or
    2. FIT College and the other providers provided it is documented in writing, and a receipt of tuition fees paid by students directly to any other providers is issued.

15. INTERNATIONAL STUDENT PREREQUISITE REQUIRMENTS

  1. Subject to the student's educational background and country of origin, you may be required to provide evidence of your English proficiency to study with us.
  2. Students are exempt from providing evidence of English language proficiency with their visa application if they fall into one of the following categories:
    1. Students who have completed at least five years of study in Australia, New Zealand, Canada, South Africa, or the Republic of Ireland or
    2. Citizens and passport holders of the UK, USA, Canada, New Zealand, or the Republic of Ireland, or
    3. Students who have successfully completed the Senior Secondary Certificate of Education or study at Certificate IV level or higher in Australia within two years of applying for a student visa or
    4. Students enrolled full-time in school studies as a principal course (including secondary exchange programs), postgraduate research or a standalone ELICOS program or
    5. Foreign Affairs or Defence sponsored students.
  3. If the student does not meet the above criteria and English is not their first language, they must provide proof of their English proficiency before starting study at FIT College. Students can provide this proof by showing that they have completed a relevant English language test. We accept results from four English language tests for student visa applications in Australia: 
    1. IELTS Academic (International English Language Testing System Academic) https://www.ielts.org/
    2. TOEFL iBT (Test of English as a Foreign Language: internet-based) http://www.ets.org/toefl/
    3. Pearson Test of English (PTE) Academic https://pearsonpte.com/

16. PRIVACY STATEMENT

  1. FIT College is committed to complying with obligations under the Privacy Act 1988 and the associated Australian Privacy Principles (APPs), specifically in how it collects, uses, secures, and discloses personal information. FIT College is committed to safeguarding any confidential information obtained by FIT College. FIT College will ensure the following:
    1. It maintains and provides a current Privacy Policy, which can be accessed on the FIT College website.
    2. Information gathered for the express purpose of training and assessment matters will not be disclosed to a third party unless the individual concerned provides prior written consent, except that required by law.
    3. The secure storage of all records.
    4. The confidentiality of all information is maintained in the records.
  2. Refer to the FIT College Privacy Policy for further information in the Student Handbook on the FIT College website. 

17. Learner Action Requests  

  1. A Learner Action Request (LAR) is an action the student takes to request to change their enrolment or registration contract. No changes are permitted if they conflict with FIT College Terms & Conditions or until FIT College approves. FIT College use the Student Platform aXcelerate as a platform for students to submit action requests. To submit an LAR, log into your Student Platform account and click 'Learner Action Requests' under the 'Student Resources' tab. Each LAR link provides details to assist with the request submission.
  2. Appeals & Complaints. Reference Policy & Procedures can be accessed on the FIT College website in the Student Handbook

18. DEFINITIONS

Accredited refers to the fitness courses that lead to a formal education such as Certificate, Diploma or Advanced Diploma.

Allowable time refers to the amount of time a student is provided to complete courses enrolled in.

AQF means the Australian Qualifications Framework.

ASQA means Australian Skills Quality Authority.

Assessment is a process to determine the student’s achievement of expected learning outcomes and may include a range of written and oral methods and practice or demonstration.

Assessment Tasks are activities set for students that enable them to demonstrate the learning outcomes of a course and make it possible for markers to determine levels of achievement.

Business day means a day that is not a Saturday, Sunday or applicable public holiday to area.

Cancellation refers to termination of the registration contract to cease all financial obligations.

Confirmation of Enrolment (CoE) is a document which is issued by FIT College confirming your enrolment.

Course means a course of education or training. Courses can either be accredited or non-accredited education or training.

Credit Transfer is a process that provides students with agreed and consistent credit outcomes for components of a qualification based on equivalent content and learning outcomes of matched qualifications.

Enrolment refers to the enrolment form required to be completed by prospective learners to access course learning materials.

Expiration refers to the fitness education student’s allowable time ending. If a course has expired, access to course is removed.

Guarantor/biller refers to consenting parties electing financial responsibility for products purchased from FIT College.

Intake Date refers to the date in which the face-to-face learning is to commence.

Intellectual Property refers to intangible property that is the result of creativity, such as patents, or copyrights.

Learner refers to the individuals who intends or is currently studying and has completed a registration and course enrolment.

Marketing is the action or business of promoting and selling products or services, including market research and advertising.

Parent/guardian refers to the individual who has legal authority and responsibility to care for student/learner (inclusive of prospective and registered).

Product refers to the courses offered to purchase from FIT College.

Prospective Learner refers to the individual who intends on studying but are yet to complete registration and course enrolment.

Recruitment is the process of assisting prospective learners to apply for a place in a course with FIT College.

Registered Learner refers to the individuals who have completed registration but are yet to complete the course enrolment.

Registration is the agreement process for the prospective learner to purchase a course offered by FIT College.

RPL means Recognition of Prior Learning which involves assessment of an individual’s relevant prior learning (including formal, informal, and non-formal learning) to determine the possibility for a credit.

RTO means Registered Training Organisation

SRTO refers to the Standards for Registered Training Organisations which are standards all RTOs are required to uphold.

Student refers to a learner enrolled with FIT College to complete purchased course.

Study Mode refers to the method in which the fitness course is provided, such as online fitness study or face-to-face study.

Suspend means to temporarily prevent from occurring.

USI means Unique Student Identifier which is a reference number unique to each student that records training from January 1st, 2015.

VET means Vocational Education and Training.
